Overview
The Uncommon Cents Commerce Center, a subdivision of Common Cents NC, operates as an online direct-sales platform specializing in collectible coins and related items (hereafter referred to as “Common Cents”). By purchasing items from Common Cents, you agree to abide by all Terms and Conditions outlined here. Disputes related to this agreement are subject to the Governing Law section of these Terms and Conditions. DISCLAIMER: Neither Common Cents NC nor the Uncommon Cents Commerce Center engages in the business of selling any items that it deems as a rare coin; both entities transact only in circulated coinage and coins that a reasonable person could consider collectible. Common Cents NC nor its Uncommon Cents Commerce Center is a precious metals dealer.
Grading Standards
Grading is inherently subjective and may vary between grading entities or numismatic experts, significantly impacting a coin’s value. Common Cents uses PCGS Grading Standards (available at https://www.pcgs.com/grades) as a reference for approximations but does not guarantee the assigned grades and offers no assurances regarding their accuracy.
Direct Sales Process
Items are available for immediate purchase via the Common Cents website (“Website”) at fixed prices. All images displayed on the Website depict the exact items for sale, though they may not reflect actual size or scale. These photographs are owned by Common Cents and may be used elsewhere with proper attribution to Common Cents upon request (email contact@commoncentsnc.com for permission). Common Cents reserves the right to remove any item from sale at any time before purchase, typically due to listing errors, without liability to potential buyers. For items with multiple identical units available (noted in the listing), the photo is representative, and certification numbers may differ, though all other attributes remain consistent.
Pricing
Common Cents lists all items with transparent pricing, reflecting the amount acceptable to Common Cents or the brand that is listing the coin(s) and/or similar item(s) for sale. There are no hidden reserves; the price shown is the price required to purchase.
Purchasing Eligibility
No registration is required to make a purchase from Common Cents. Buyers must be at least 18 years old. Common Cents may, at its exclusive discretion, decline or cancel any purchase from any individual without providing notice or explanation.
Sales Process
Items are available for direct purchase at the listed price on https://commoncentsnc.com/common-cents-commerce-center/. If you encounter issues during the purchase process, contact us at (704) 350-5874 or via email at contact@commoncentsnc.com for assistance. Once purchased, items are added to your invoice for immediate payment. Common Cents reserves the right to adjust or cancel any listing due to errors, without obligation to buyers, and will strive to notify customers of such changes on the Website as soon as practical.
Invoicing and Fees
After purchase, your items will appear on an invoice accessible via email from our payment and invoicing processors – PayPal and WooCommerce. Payment options are clearly marked in the checkout process. Local Pickup is an option in some cases. Shipping costs will be added per the USPS Simple Plugin at rates returned from the United States Postal Service at the time of purchase.
Sales Tax
North Carolina residents will be charged applicable state sales tax on purchases. Common Cents does not collect sales tax for buyers outside North Carolina; it is the buyer’s responsibility to report and pay any required sales tax in their own state per local laws. International buyers are solely responsible for any customs duties imposed by their country.
Payment Terms
Accepted payment methods are outlined in the checkout process. Payment is immediately to successfully complete the checkout process.
Credit Card Transactions and Dispute Limitations
When paying by credit card or like method, including PayPal, you authorize Common Cents to charge the full invoice amount, including service fees and shipping costs, to the card provided at checkout. To protect both parties and ensure transaction integrity you explicitly agree to the following:
- Dispute Restrictions: You agree that any credit card chargeback or dispute initiated with your card issuer is invalid and unenforceable unless you can demonstrate, with clear and convincing evidence, that Common Cents engaged in gross negligence, fraud, or egregious misconduct directly causing verifiable harm related to the transaction. Examples of such acts include, but are not limited to, intentional shipment of counterfeit items or willful refusal to fulfill a paid order without cause. Disputes based on buyer’s remorse, subjective dissatisfaction with item grading (per PCGS standards as approximations), delays beyond our reasonable control, or failure to adhere to these terms do not qualify.
- Pre-Dispute Notification: Before initiating a chargeback, you must notify us in writing at contact@commoncentsnc.com within 3 calendar days of receiving your order, detailing the issue and providing evidence of gross negligence, fraud, or egregious misconduct. We will have 14 business days to investigate and respond. Failure to follow this process waives your right to dispute the charge.
- Chargeback Costs: If a chargeback is filed and deemed invalid under these terms, you agree to reimburse Common Cents for all associated costs, including bank fees (e.g., $30 per chargeback), legal fees, and administrative expenses, plus interest at 5% per month on unpaid amounts, or the maximum rate permitted by North Carolina law, whichever is greater.
- Transaction Finality: Once payment is processed and cleared, the transaction is considered final, subject to our return policy. You acknowledge that all sales are “as is” with no warranties beyond title, and grading approximations follow PCGS standards (https://www.pcgs.com/grades). Credit card payments do not entitle you to additional recourse beyond what is explicitly provided herein.
Fraud Prevention
For large transactions (any transaction over $5,000), or suspected fraud, we may require payment by wire, delay shipment until funds clear, or request banking references. We reserve the right to refuse or cancel any transaction at our exclusive discretion without liability, especially if fraud or misuse is suspected.
Non-Payment Consequences
Non-Payment or Fraudulent Disputes: If payment is not received or a dispute is initiated:
- Joint buyers are jointly and severally liable for all obligations. A $50 fee applies to returned checks or declined transactions.
- We may cancel the transaction, retain or resell the items, and charge you for all resulting costs, including service fees, shipping, and resale expenses.
- You remain liable for any shortfall between the original purchase price and resale proceeds, plus collection costs, attorney fees, and interest at 5% per month on unpaid amounts, or the maximum rate permitted by North Carolina law, whichever is greater.
- We may offset unpaid amounts against any funds or items you have with us and assign our rights to a third party for collection.
Shipping Policy
Items ship to the address provided at checkout, which you must verify during payment. Common Cents uses USPS Simple and allows its users to choose the shipping methods available from the United States Postal Service at the time of purchase. We offer limited insurance for loss, theft, or damage while items are in our possession or during shipment, up to $100 (standard USPS insurance coverage). If additional insurance coverage is requested or required, the buyer is solely responsible for those costs and those costs must be paid prior to shipping. Claims for loss or damage must be submitted in writing within 3 calendar days of shipment arrival or 30 calendar days for non-arrival and must comply with all insurer and postal requirements. Not following this section in any capacity voids any and all claims.
Return Policy
Common Cents offers a return option as follows:
- Certified items must remain in their original, sealed grading holders.
- Notify us within 3 calendar days of receipt for a return confirmation number, and return the item via insured mail within 3 calendar days.
- Shipping costs are non-refundable, and returns require the confirmation number.
- Buyers may return one item free per month; additional returns incur a 10% fee based on total price paid for the item at the time of checkout, discounts excluded.
- Abuse of this policy may result in loss of return privileges, and no returns are accepted if the buyer pre-viewed the item or offered it for resale elsewhere.
Inventory Ownership
While not our primary focus, Common Cents may own items or hold an economic interest in listed products (e.g., advancing supplier funds). We reserve the right to sell such items directly.
NO WARRANTY
NO EXPRESS OR IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE PROVIDED EXCEPT FOR TITLE. COMMON CENTS SELLS ONLY THE TITLE HELD BY THE SUPPLIER AS OF THE SALE DATE. COMMON CENTS EXPLICITLY FOLLOWS CAVEAT EMPTOR AND AS SUCH ALL ITEMS ARE SOLD “AS IS” WITH ALL FAULTS, AND BUYERS ASSUME ALL RISKS RELATED TO GRADING, QUALITY, CONDITION, AUTHENTICITY, AND ORIGIN BASED ON PCGS STANDARDS AS APPROXIMATIONS.
Market Risks
The collectible coin market is speculative, volatile, and unregulated, with prices subject to fluctuation. Common Cents does not provide investment advice or guarantee future resale value.
Governing Law
THESE TERMS ARE GOVERNED BY AND INTERPRETED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NORTH CAROLINA AND APPLICABLE UNITED STATES LAW, WITHOUT REGARD TO ANY CONFLICT OF LAWS PRINCIPLES. YOU AGREE THAT ANY LEGAL ACTION OR EQUITABLE PROCEEDING ARISING FROM OR RELATED TO THESE TERMS SHALL BE INITIATED SOLELY IN THE STATE AND FEDERAL COURTS LOCATED IN MECKLENBURG COUNTY, NORTH CAROLINA AND YOU HEREBY IRREVOCABLY AND UNCONDITIONALLY AGREE AND SUBMIT TO THE EXCLUSIVE AUTHORITY OF THOSE COURTS FOR ANY LAWSUIT, ACTION, OR PROCEEDING STEMMING FROM THESE TERMS OR USE OF OUR SERVICES OR SITE.
